1. Acceptance of terms
By accessing or using SmartCellar at smartcellar.wine ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of service
SmartCellar is a wine cellar management service that allows you to catalogue your wine collection, record tasting notes, share a cellar with others, and use assisted wine research and recommendations. The Service is available in free and paid subscription tiers.
3. Account registration
To use the Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
You are responsible for all activity that occurs under your account.
4. Subscription plans and payments
SmartCellar offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe, according to the interval you choose. Displayed web prices include 20% UK VAT. For overseas customers, applicable tax depends on the billing location and is shown in the final checkout total. Subscription invoices itemise applicable tax. By subscribing to a paid plan, you agree to pay the total shown before confirmation.

- You may cancel your subscription at any time; access continues until the end of the current billing period
- We reserve the right to change subscription pricing with 30 days' notice

5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious content or use the Service to distribute spam
- Resell, sublicence, or commercially exploit the Service without permission
- Abuse the AI features by attempting to bypass usage limits or extract training data
6. Your content
You retain ownership of all content you submit to SmartCellar, including wine details, tasting notes, photos, and other data. By using the Service, you grant us a limited licence to store, process, and display your content as necessary to operate the Service and its features, including assisted analysis.
You are responsible for ensuring that any content you upload does not infringe on the intellectual property rights of others.
7. AI features disclaimer
SmartCellar's assisted features, including Cella, bottle profiles, scans, valuations, and cellar insights, are provided for information and enjoyment. Generated recommendations, valuations, and descriptions may be incomplete or inaccurate. Check important details and do not rely on these outputs alone for purchasing decisions or health-related advice. We do not guarantee the accuracy or completeness of generated content.
8. Cellar sharing
When you share your cellar with other users, you control the level of access. You are responsible for managing who has access to your cellar. Users with edit access may add, edit, or remove wines from your shared cellar. You may revoke sharing permissions at any time.
9. Service availability
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend the Service for maintenance, updates, or other reasons. We are not liable for any loss or damage caused by service interruptions.
10. Limitation of liability
To the fullest extent permitted by law, SmartCellar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or damage arising from your use of the Service.
Our total liability to you for any claim arising from or relating to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Termination
You may close your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before closing your account.
12. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
